1.) Purchaser agrees and binds him/herself to take good and reasonable care of this kitten/cat so as to provide appropriate food, shelter, correct routine, accident or health related medical care, proper grooming, exercise and human attention. Buyer promises and warrants that said kitten/cat will not be confined to a cage for extended periods of time. Purchaser agrees that said kitten/cat will not be allowed outside without supervision, and to not de-claw cat. Abuse, neglect or lack of adequate care will result in Purchaser relinquishing kitten/cat to Breeder unconditionally with no compensation.

Purchaser agrees to never sell, rent, loan, trade, or give away kitten/cat. If a need for re-homing should arise, Purchaser agrees to contact Breeder first so that Breeder may help to re-home the kitten/cat.

This kitten/cat will not be re-homed with out the prior notification and permission of Breeder.

Said kitten/cat must remain on diet suggested by Breeder for a minimum of two weeks after delivery before switching to another diet. When switching diets, it must be done gradually to allow the kitten/cat to adjust. The Purchaser agrees to
continue a good quality diet in the best interest of the cat/kitten.

If Purchaser wishes to allow cat outside, it must be within a safe and secure cat enclosure or on a leash with a harness (not a collar). Guarantee is null and void if kitten/cat has been allowed out unsupervised. If said kitten/cat is stolen or lost for any period of time, health guarantee is null and void.

Purchaser agrees to send updates with current photos of said kitten/cat a minimum of once yearly through out the said kitten's/cat's lifetime to Breeder.

2.) Buyer agrees to pre-pay Breeder for the balance of the cat/kitten and any and all shipping and associated costs for this kitten at least 3 weeks before the take home date. This includes the actual shipping costs, cost of health certificate, and cost of carrier if required, unless other arrangements have been made and approved by Breeder. Buyer understands that these fees are non-refundable and are NOT included in the purchase price of said kitten/cat. Purchaser will leave with health record, vaccination records, food the kitten/cat is presently eating and a few toys (it is the responsibility of the new owner to supervise with all toys). Pedigree and registration papers will be sent before or with said kitten/cat once veterinary proof of neuter had been provided to Breeder. All veterinary costs and transportation costs to and from the Purchaser will be the responsibility of the owner and not Breeder.

Purchaser agrees to never vaccinate or de-worm said kitten/cat while sick. Doing so may result in death. If Purchaser fails to heed this, the contract will be null and void.

3.A) Said kitten/cat is in good health. If the cat/kitten should become ill or die from a problem present prior to placement while the kitten is still in Breeder’s possession, the Breeder will replace the cat/kitten with another of equal value within 12 months.Kittens/cats are not guaranteed against accidental death or injury at any time after sale. Please isolate said kitten/cat for a period of not less then 3 days (14 days is recommended) if brought into a multi-pet household. Please have this kitten/cat examined by your veterinarian 72 hours from purchase date, so both parties are confident that the kitten/cat is completely healthy. Breeder cannot be responsible for contagious diseases the kitten/cat is exposed to during shipping that are not evident during the initial guarantee period. No refunds will be given after 72 hours. If the kitten/cat goes into a multi-cat family, it is the responsibility of the Purchaser to have complete blood profiles done including FIP (corona titer), FIV, FeLuk, and fecal testing done and sent to Breeder, before kitten/cat can be returned. The cost of this testing will be at Purchaser's expense. kittens/cats are not guaranteed to be hypo allergenic - please test for allergies before getting a kitten/cat if you are unsure.

3.B) This kitten/cat cannot be guaranteed to be free from Feline Enteric Corona Virus (FeCV). It is estimated by a research physician at the University of Missouri Veterinary Teaching Hospital that 93.7% of all cats have contracted Feline Enteric Corona Virus. FeCV can, on rare occasions, mutate, and cause the fatal disease Feline Infectious Peritonitis (FIP). The effectiveness of the FIP vaccine is still controversial. Many researchers and veterinarians believe it can create enough stress on the feline immune system to actually cause the disease, others believe that it is completely ineffective. Although research is continuing, at this time no one knows exactly why this disease occurs, or how to completely prevent it. Therefore, this entire health guarantee is null and void if the FIP vaccine is administered to this kitten/cat. Once again, the Breeder cannot guarantee that this kitten/cat will never contract this disease. No Breeder can. However, should this kitten/cat die from FIP within one year of living in its new home, Breeder will replace the kitten/cat with one of Breeders choosing under the following conditions:

 a) Complete necropsy, histopathology and microscopic examination of tissue by a trained pathologist must be performed.

 b) Written and signed necropsy report must be received by the Breeder.

 c) If you have a multi-cat household, two Corona Virus Titers, six (6) weeks apart must be performed on the remaining cats (this is a simple blood test, sent via U.S. express mail).

Breeder does everything possible to prevent this disease from occurring. For more information on this disease, please visit these websites: www.orionfoundation.com  and/or www.dr-addie.com

Buyer understands that the Breeder recommends NEVER vaccinating against FIP (Feline Infectious Peritonitis) because the effectiveness of the vaccine has not been established, and because the vaccine can cause a cat to come down with FIP instead of preventing it. Buyer agrees NOT to vaccinate this cat/kitten against FIP.

4) This kitten/cat is guaranteed for a period of 2 years (from the date of purchase) against death from any hereditary or genetic illness.

In the event that this kitten/cat is found to have a congenital defect or genetic disease that results in:

a.) If euthanasia is considered to be necessary or imminent, a replacement kitten/cat will be given. NO KITTEN OR CAT IS TO BE EUTHANISED WITHOUT THE PRIOR KNOWLEDGE OF THE Breeder, EXCEPT IN THE CASE WHERE A LICENSED VETERINARIAN CONSIDERS IT THE ONLY HUMANE ALTERNATIVE, OR THE GUARANTEE IS VOID. An autopsy is required to confirm a medical diagnosis in this case.

b.) If a pet is diagnosed with a minor imperfection (not known at time of sale) that requires no treatment and does not interfere with the normal function and purpose of the cat as an active pet, then no credit will be given.

c.) Where a replacement is requested and where euthanasia is necessary, Purchaser agrees to grant full access to all veterinary records to Breeder. Veterinary records include copies of actual visit cards to veterinarians stating vaccinations, injuries, test results, etc. during the period the kitten/cat is owned by the Purchaser. No replacement will be given for any condition or defect caused by accident, neglect or malnutrition. Purchaser is responsible to provide immediate veterinary care to any kitten/cat showing signs of illness or distress. If said kitten/cat becomes ill or dies, Purchaser is to notify Breeder immediately. Failure to do so will render this guarantee null and void.

BREEDER ASSUMES NO LIABILITY FOR VETERINARY COSTS OR OTHER EXPENSES INCURRED BY THE OWNER. PURCHASER ACKNOWLEDGES THAT BREEDER'S LIABILITY CAN NEVER EXCEED WHAT IS EXPRESSED IN THIS GUARANTEE AND AGREEMENT AND IS LIMITED TO PHYSICAL REPLACEMENT OF KITTEN/CAT.

5.) Should it become necessary for any reason to part with this kitten/cat, this contract becomes null & void. This contract is NOT transferable.

6.) Replacement kittens/cats to be of same quality as originally purchased unless other arrangements are made between the two parties. Replacement kittens/cats to be granted within 12 months from purchase date. Replacement kittens/cats will only be given granted that the kitten/cat it is replacing has been returned alive, and proof of veterinary analysis of condition is given. If kitten/cat to be replaced is deceased, an autopsy at the expense of the Purchaser must be done and results given to Breeder.

7.) No habit is guaranteed for or against. Any habit, good or bad, can be made or broken, so we can not guarantee this.

8.) All shipping costs are the responsibility of the purchaser. If said kitten/cat is hand delivered, we ask to view your photo id to ensure that the correct person collects the said kitten/cat.

9.) If you desire to have another person(s) be permitted to receive the said kitten/cat from us for you, please specify (Full Names Please):

10.) Said kitten/cat is not to be used for breeding. Breeder agrees to have said kitten/cat altered (spayed or neutered) by 6 months of age, or within a month of purchase if older than 6 months when purchased and proof sent to Breeder. If proof of spay/neuter is not provided to Breeder within one month from the time the kitten reaches 6 months old, then Breeder will assume that buyer has an “intent to breed” this kitten/cat and buyer will owe Breeder the sum of $2,500.00 for a breeding fee. If said cat is found to have been used for breeding, said cat and all it's offspring must be relinquished to Breeder with no compensation. All health testing, altering, and other re-homing costs of said cat and all offspring will be at Purchaser's expense with no compensation.

11.) If this contract is breached in any way, Purchaser will owe the Breeder a fee of $2,500.00US for breach of contract to the Breeder, over and above the original price, for each violation of the contract. Once the contract is breached, Purchaser is to surrender the cat/kitten back to the Breeder without refund and at the Purchaser’s expense. Purchaser also agrees that if any legal action needs to be taken that all legal fees will be Purchaser’s responsibility for both parties and it will be held in Breeder’s current state and county of residence.

Please be sure to read and understand this Agreement before signing. If you have any questions, please ask before signing this agreement. This Contract is legally binding to all parties involved. It applies only to the Purchaser and Breeder (Julieann Wright) in this transaction and is non-transferable to other parties.
